Well Ahmed, the problem is that during the Bosman case UEFA tryed to tell the Advocate General that sports were seperate from employment in the EU, but he rejected that outright, along with a lot of other weak defences. Since the EU is built on 4 freedoms, 2 which are for movement of workers and services, it goes against the EC Treaty (Rome Treaty) to allow them to do that. If it goes ahead the Advocate General on the case would have to disregard 3 different Articles of the Rome Treaty, the 4 freedoms of the EU and minor precendence, so I don't think it will go through. If it does, what Sepp Blatter said about slavery will come true.

Very interesting and deserves more research Greg.

UEFA (Platini) are pushing to have 'Sports' declared as a special category of employment under EU rules (Platini claims to have support from other heads of European sports federations as well) so that UEFA and FIFA can impose restrictions on clubs with respect to economics and squad composition.

If they can change EU laws and give sports special status, UEFA will be free to dictate rules to football clubs in Europe without any sanctions (apart from CAS, of course).

Wow! I knew little of this before reading your article. My opinion of FIFA is rock-bottom, mainly because of Blatter and his dictatorial persona.

Personally, I believe that FIFA will become more and more powerless as a result of legal issues. Football is big business now and they can't interfere with the law of the land. I love to watch Blatter pontificate and then squirm as reality sets in.

Great research and a really insghtful and intelligent piece. We could do with much more of this.

Unfortunately, writing at this level seldom gets much debate on here. But hopefully this will be an exception!
